Medical Malpractice Insurance in Washington
Medical professional liability insurance rates in the state of Washington are almost 25-percent more expensive than those in neighboring Oregon and Idaho. With that caveat, Washington’s malpractice rates are slightly more expensive than the median of the nation’s spectrum, and the state is one of the few that has realized a significant reduction in medical liability premium dollars over the course of the last few years.
The most recent attempts to reform the Evergreen State’s tort system began in 2005, when the physician and trial lawyer lobbies engaged in a battle for votes on competing ballot initiatives. The physician, hospital and nursing communities campaigned for I-330, a tort reform package that centered around a $350,000 cap on non-economic damages and would limit attorney fees; trial lawyers politicked for I-336, which would establish a state-run supplemental liability insurance program and a three-strikes rule where doctors convicted by a jury of three malpractice events would lose their license for a 10-year period. The campaigns for I-330 and I-336 set a record for the most expensive ballot fight ever in Washington, with almost $16.4 million raised by both sides. Neither ballot initiative was passed by the electorate—with I-330 losing by a margin of 43 to 57 percent and I-336 losing 40 to 60 percent.
While the failure of either ballot initiative to pass appeared to be a colossal waste of money, it did set the table for Gov. Christine Gregoire to broker a series of compromise tort reforms that would pass in 2006.
Gov. Gregoire was able to get both sides of the tort reform argument to the table and agree to compromise legislation that allows doctors to apologize for a medical mistake without the apology being used against them in court; allows juries to hear if an injured patient received payment for the claim from an insurance company; require initial mediation when a malpractice claim is filed; and require plaintiff attorneys to file a certificate of merit by a medical professional from the discipline involved in the case prior to trial. Not all parts of the compromise passed judicial scrutiny; in 2009, the Washington Supreme court ruled the certificate of merit rule was unconstitutional.
Perhaps most significant to the 2006 compromise was that it requires the state to collect detailed statistics about malpractice claims filed in the Washington Court system. Under the law, data on medical malpractice claims by insurers and self-insurers that have been settled—with or without a payment—must be reported to the insurance commissioner, who is mandated to publish annual statistical summaries. This data is hoped to replace campaign bombast with empirical data the next time the tort reform argument gets heated.
The 2006 reforms have had a noticeable impact on medical professional liability insurance premiums in Washington. Physicians Insurance A Mutual—the state’s largest insurer, writing policies for 62 percent of Washington’s healthcare community—reduced rates by 10 percent in 2009, and reducing rates by an additional 8 percent in 2010. Many in the tort reform community point to the 2006 legislation as responsible for the ease in premiums.
