Pennsylvania Medical Malpractice Insurance
Pennsylvania medical malpractice insurance premiums has a long history of sky-high premiums and legislative efforts to reign in those soaring rates.
When trying to make sense of Pennsylvania’s historically complex medical malpractice insurance climate, the best place to start is the nationwide liability crisis of the mid-1970s. During this period, the Pennsylvania medical community—like most across the country—faced serious challenges to the affordability and availability of medical malpractice insurance. The commonwealth’s then-largest medical liability insurer, Argonaut, threatened to stop writing policies altogether; then sought, in 1975, a premium increase of 200 percent for many specialties. In response, the Pennsylvania Medical Society and General Assembly worked together to become among the first states to pass wide-ranging legislative reforms to the medical liability crisis gripping the country.
The Health Care Services Malpractice Act (Act 111) of 1975 created the Medical Professional Catastrophic Loss (CAT) Fund. The CAT Fund was the United States’ first public patient compensation fund (PCF), a state-established liability-funding instrument that provides medical professional liability coverage in excess of a physician’s primary insurance limits. Act 111 mandated, for the first time, malpractice insurance coverage for hospitals and healthcare providers as well as created the commonwealth’s Joint Underwriting Association (JUA), an insurer of last resort for physicians who would otherwise be uninsurable. Act 111 also restricted attorney fees, mandated arbitration panels and established a collateral source offset rule, but these three provisions were ultimately struck down as unconstitutional by the Pennsylvania Supreme Court, marking the start of an ongoing clash between tort-reform-minded interests and the commonwealth’s court system, which during last three-and-a-half decades has struck down more than 25 reform articles.
Less than a decade after the reforms of 1975, Pennsylvania again entered a period—albeit less severe—of medical liability crisis with annual premium rate increases of 25 to 30 percent on average. But it was not until 1996 that the commonwealth took any legislative action to curb the rise of malpractice rates.
Act 135, a 1996 amendment to Act 111, imposed a punitive (not noneconomic) damage cap of $100,000; sanctioned affidavits of non-involvement, where a physician could swear under oath that he or she was not involved in a case and be cleared of any wrongdoing; started to reduce CAT Fund surcharges; and placed a four-year moratorium on further medical liability legislation.
As the most recent medical liability crisis began to unfold in 2001, partly do to the peripheral effects of the Sept. 11, 2001 terrorist attacks, the reforms contained in Act 135 did little to slow the growth of medical malpractice insurance rates, and three of the commonwealth’s five major malpractice insurers ultimately ceased writing in Pennsylvania.
Pennsylvania was one of the first states to address the most recent medical liability crisis (2001-2005). The sweeping set of reforms known as the Medical Care Availability & Reduction of Error Act (MCARE or Act 13 of 2002) were comprehensive, addressing medical errors within the healthcare system, the legal system and the malpractice insurance industry.
With a new emphasis on patient safety, the MCARE Act included nine provisions on healthcare error reduction. It created a Patient Safety Authority, required all hospitals to incorporate detailed patient safety plans and mandated annual reports on hospital-acquired infections.
The MCARE Act included a range of legal reforms that restricted frivolous lawsuits by instituting stronger expert witness qualifications as well as sanctions against lawyers bringing those claims. It also implemented policies expected to reduce excessive awards, but did not include the holy grail of noneconomic damage caps.
The MCARE Act also restructured the CAT Fund, henceforth referred to as the MCARE Fund, with $400 million in state subsidies to reduce physician assessments paid into the Fund. The Act also increased assessments for doctors with excessive claims and required insurers to offer patient-safety discounts and credits.
