Medical Malpractice Insurance in Oregon
Medical professional liability insurance premiums in Oregon are moderate when compared to the rest of the nation, but the state has a strong base of tort reform advocates that are consistently lobbying for greater reforms to reduce the liability burden on its healthcare community.
The modern history of tort reform in Oregon begins with the run-up to the 1987 passage of a significant tort reform package. At the time, medical professional liability insurance premiums were on the rise, inciting a march on the state capitol by Oregon’s healthcare community to demand tight limits on liability lawsuit awards and greater regulation of insurance premiums, and the state legislature undertook extensive efforts to change existing tort law. Crafted in bipartisan fashion by Democratic and Republican representatives, the compromise legislation placed a $500,000 cap on non-economic damages in cases of medical negligence as well as placed new limitations on joint-and-several liability.
The 1987 reforms had a nominal effect on medical professional liability insurance premiums, and by 1995, tort reform advocates were again lobbying Oregon’s legislature for greater reforms to the civil justice system. This time, reform advocates set their sight on “Loser Pays” legislation that would have mandated the losing party in a civil action pay the court and attorney fees of the victor. Claiming that this would limit the court system to the wealthy, who could afford the gamble of losing in court, violating equal access to the court system. The strict “Loser Pays” portion of the tort reforms never made it to law, but the new reforms that did receive passage included a limit on attorney contingency fees; mandated arbitration in most cases involving less than $50,000; encouraged settlement conferences; penalized a frivolous lawsuits as well as poorly prepared court documents and motions; mandated attorney fee and court cost awards in certain cases; provided criteria for the discretionary award of court costs and attorney fees in a wide variety of other cases; modified punitive damage awards; and limited attorney shares (to 20 percent) of punitive damage awards.
In July 1999, the Oregon Supreme Court ruled in the case of Lakin v. Senco Products that the 1987 cap on non-economic damages was unconstitutional. The high court pointed to Article I, Section 17 of the Oregon Constitution, which states “In all civil cases the right of trial by jury shall remain inviolate.” According to the court, this provision prohibits the legislature from passing any damage cap that interferes with a jury’s assessment of non-economic damages.
In response to the Supreme Court decision, the legislature passed HJR 2, which referred the matter to Oregon voters as a ballot initiative to amend the constitution, asking voters to grant the legislature constitutional power to impose caps. The measure appeared on the 2000 ballot as Measure 81, and was defeated. Oregon no longer had any cap on non-economic damages in civil cases.
Following the Oregon Supreme Court’s decision, medical professional liability insurance premiums have risen, and following the significant gains in 2010 by Republicans in state government, tort reform is again at the top of the legislatures agenda. And last year, the Oregon Health Policy Board appointed a 15-member task force charged with finding new ways to address the state’s liability issues.
