North Carolina has long been a pioneer in methods of alternative dispute resolution. These methods are more beneficial in many ways than regular court procedures. They generally offer a simpler means of settling disputes, and include mediation, arbitration, a summary jury trial and early neutral evaluation. There are several advantages common to each form of alternative dispute resolution, and North Carolina first began exploring the benefits in medical professional liability lawsuits in 1991, establishing a series of pilot programs that required the mediation of civil actions.
While the alternative dispute resolution system devised in 1991 was not binding, if an agreement was reached in mediation/arbitration, the mediator/arbitrator would prepare a summary document that summarizes the terms agreed upon. The parties and their counsel would then use the summary document as a guide to drafting such agreement to give legal effect to the terms of the summary document. This system of alternative dispute resolution was effective in reducing the length of conflict and overall cost of court proceeding.
Sixteen years later, the alternative dispute resolution had become widely accepted by both sides of the medical malpractice legal system, and both physicians and lawyers agreed on a new wrinkle to the arrangement.
In 2007, the North Carolina General Assembly passed the Voluntary Arbitration of Health Care Claims Act, which placed a $1 million cap on total damages in medical professional liability claims where both parties agree to resolve their dispute via binding arbitration. The law outlined a range of different legal mechanisms created to resolve medical malpractice claims more quickly and less expensively than a traditional court case.
The Voluntary Arbitration of Health Care Claims Act offered the first cap on damages for medical malpractice in North Carolina. It also created specific procedures and timelines for selecting arbitrators and conducting discovery. Because it created a well-defined system of alternative dispute resolution for medical liability cases, it offered a greater sense of predictability in such cases. As such, medical professional liability insurance providers were able to offer greater stability in its premiums. Riding the wave of Republican victories in the 2010 midterm elections, the conservative-controlled General Assembly has promised to again address medical malpractice insurance issues. North Carolina State Senator Stan Bingham has introduced a bill that would ratchet down the cap on damages to $250,000; other legislators are working on bills that would switch contributory negligence to comparative negligence and end the doctrine of joint and several liability.
