Medical Malpractice Insurance in Nevada
Nevada is a state just starting to realize the benefits of a 2004 ballot-initiative tort reform on medical malpractice insurance rates. It is also one that may see its progress eroded.
The Fight for Tort Reform
In the face of skyrocketing medical malpractice insurance rates, the Nevada Legislature passed tort reform in 2002 that placed a $350,000 cap on non-economic damages, but held exceptions for gross negligence and exceptional circumstances, which physicians argued nullified any impact on rising med-mal insurance rates. The issue was ultimately decided in favor of the physicians when voters approved the 2004 “Keep Our Doctors in Nevada” ballot initiative, which rescinded any exceptions to the non-economic damages cap as well as added additional barriers to filing frivolous lawsuits.
The number of claims filed dropped by more than 50 percent the year after the ballot initiative went into place, and in 2007, medical malpractice insurance rates in Nevada started to experience the promised deflating effect of a hard cap on non-economic damages.
Challenges to Nevada Tort Reform Progress
In the wake of the recent, highly publicized case in which two Nevada health clinics used contaminated medical equipment, exposing thousands of patients who received colonoscopies to possible disease, and more than a hundred patients have tested positive for Hepatitis C, the Nevada Legislature passed a bill that would lift the medical malpractice cap of $350,000 for non-economic damages in cases of "gross negligence" or when a jury finds “a conscious indifference to the consequence of the actions or an indifference to the safety and welfare of a patient.” The bill would also give patients an extra year to determine if they should bring suit. This bill has the potential to reverse the ground physicians have gained in lowering medical malpractice insurance premiums. Time will tell how much.
