Medical Malpractice Insurance in Missouri
Medical professional liability insurance is expensive in Missouri. High-risk specialties pay base-rate premiums that hover around $100,000 annually, and more moderate-risk physicians (e.g., general practitioners) annually pay around $20,000 in premium—but there is reason for hope that there will be soon downward pressure on these rates. In 2005, the Missouri General Assembly passed comprehensive medical liability reforms that its proponents say should start bringing down premium costs in the near future, and in 2010, the Missouri Supreme Court ratified the constitutionality of the state’s updated non-economic damages cap.
The modern push for tort reform began in Missouri at the turn of the last decade, when medical malpractice insurance premiums were doubling and tripling across the country. One of 20 states the American Medical Association declared to be in crisis because of its liability climate, Missouri doctors began curtailing high-risk procedures, and the number of physicians practicing in the state began to dwindle as they retired or moved to neighboring states with more reasonable malpractice costs. In the eastern part of Jackson County—one of Missouri’s largest—its only neurosurgeons closed their doors in 2003 due to high malpractice insurance costs; one obstetrician—who delivered more than 200 babies a year—retired after his annual premium jumped by 82 percent in one year.
By 2003, the Missouri Hospital Association had declared that the state’s healthcare community was practicing on life support. The organization began to lobby the state assembly for significant tort reforms in order to hold down malpractice insurance premiums and ensure greater access to healthcare for all Missourians. Legislators acknowledged the toxicity of the state’s liability climate; twice passing tort reform laws that were ultimately vetoed by then-Gov. Bob Holden.
Recognizing a political advantage, then-secretary of state Matt Blunt ran for the governorship on a platform that promised he would sign tort reform legislation if inaugurated. Blunt won the election, and signed HB 393, which modified 19 sections of the Revised Statutes of Missouri relating to tort damages in Missouri, its greatest impact in the area of medical malpractice tort actions. Following are the five pillars of Missouri’s HB 393 tort reforms:
- Central to HB 393 was its revision of the state’s cap on non-economic damages. The state first created a $350,000 non-economic damage cap in 1986, but allowed for adjustments due to inflation; by 2005, it had adjusted to $579,000. The new cap was reset at $350,000 with no provision for inflation adjustment. Proponents of the hard cap argued the static nature of the cap would offer insurance companies a greater ability to predict losses and reduce premium rates. HB 393 also deleted the word “occurrence” from the law, thereby clarifying that multiple caps cannot apply to a single defendant (the Missouri Supreme Court previously interpreted the term “per occurrence” to apply to each individual act of negligence, even if multiple caps could apply to a single defendant).
- HB 393 restricted an award for punitive damages to no more than $500,000 or five times the amount of the net judgment awarded to the plaintiff, and punitive damages must be determined in a separate trial before the same jury if requested by any party.
- HB 393 strengthened Missouri’s statute of limitations for minors, requiring a minor to bring a lawsuit by his or her 20th birthday, but no later than 10 years after the alleged act of malpractice. Previously, the law only required a lawsuit to be filed no later than 10 years from the minor’s 20th birthday.
- HB 393 further restricted joint-and-several liability so that a defendant can only be held jointly liable for damages if he or she is found to be more than 51 percent at fault. A defendant who is deemed less than 51 percent at fault can only be responsible for damages in proportion to his or her degree of fault.
- HB 393 also strengthened Missouri’s affidavit of merit law, defining “legally qualified healthcare provider” as one who is licensed in the same specialty as the defendant.
Applauded by the Missouri healthcare community, HB 393 helped to stabilize liability rates in the state, but many insurers shied from actually lowering rates prior to the Missouri Supreme Court to weigh in on the constitutionality of the reforms. In 2010, the state’s highest court endorsed the law’s $350,000 cap on non-economic damages in medical liability lawsuits.
