Mississippi Medical Malpractice Insurance
Medical malpractice insurance premiums in Mississippi are moderate, but that hasn’t always been the case. Prior to reforms enacted almost 10 years ago, malpractice insurance rates were weathering annual double-digit increases and many of the states doctors were looking elsewhere to practice.
As the medical malpractice insurance industry entered a nationwide hard market during the early 2000s, Mississippi was especially hard hit and carried with it the stigma of being widely considered “the lawsuit capitol of the world.” With malpractice insurance costs higher than other states, and med-mal insurance premiums escalating annually, many doctors either retired early or moved to a state with a more favorable liability climate. And the impact on Mississippians’ access to healthcare was dramatic. Most cities with populations of less than 20,000 people had no access to an obstetrician, and specialists were becoming increasingly scarce.
Mississippi first acted to curb the number of medical malpractice lawsuits—and rein in medical malpractice insurance premiums—during a special session of the state legislature called in late 2002. The resulting legislation, House Bill 2 (HB2), made several important changes to the state’s liability laws. At the heart of HB2 was a $500,000 cap on non-economic damages, although there were exceptions for piercing the cap and allowances were made for the cap to be adjusted for inflation. The legislation also required plaintiffs give defendants 60-days written notice prior to filing a medical malpractice lawsuit, necessitated that medical malpractice plaintiffs attorneys consult with an expert prior to filing and abolished joint liability for non-economic damages for a defendant found to be less than 30 percent at fault.
During the same special session of the legislature, lawmakers enacted House Bill 19 (HB19), which ended the practice of venue shopping. Previously, attorneys would file their medical malpractice claim in traditionally plaintiff-friendly jurisdictions. HB19 mandated that lawyers file medical malpractice insurance lawsuits in counties that have a “relationship to the facts of the case,” and further restricted punitive damages and authorized a minor penalty for frivolous filings.
While the reforms contained in HB2 and HB19 became effective for causes of action filed on or after Jan. 1, 2003, the Mississippi tort reform movement got a shot in the arm with the election of Haley Barbour to the governorship. Barbour, a pro-business, pro-healthcare conservative, called another special election after his inauguration in 2004.
During the 2004 special session, Barbour helped usher through the legislature a remarkably comprehensive civil justice reform bill. House Bill 13 (HB13) included reforms that further strengthened, and built upon, those passed in 2002. For instance, HB13 placed a “hard limit” of $500,000 on non-economic damages in medical malpractice court cases, removing exceptions for piercing the cap found in the 2002 reforms as well as inflation adjustments. It further tightened the requirements against venue shopping and completely abolished joint liability for all defendants.
The statistical results following the 2002/2004 reforms have been dramatic. Since the reforms went into effect, medical malpractice insurance premiums have dropped by as much as 60 percent for some specialties and claims dropped by 91 percent from their peak. Medical Assurance Company of Mississippi (MACM), the states largest insurer of medical liability, reports that—between 2000 and 2004—their insured OB/Gyns experienced an average of 44 lawsuits a year; in the five year period 2004 to 2009—after the reforms had taken effect—those same MACM obstetricians averaged only 15 lawsuits a year. And the decline in frequency directly resulted in dividends given back to MACM’s insureds each year from 2006 to 2010.
