Medical Malpractice Insurance in Michigan
With the exception of high-risk specialties in certain counties, Michigan physicians pay relatively moderate premiums for medical professional liability insurance. These moderate premiums are almost universally attributed to tort reforms that were enacted in the 1980s and 1990s, which were confirmed constitutional by the state’s Supreme Court in the 2000s. In fact, Michigan’s reforms are so strong that Forbes magazine has regularly ranked its tort system among the top three in the nation.
By the mid-1980s, Michiganders were experiencing a serious access to healthcare dilemma. Medical malpractice claims in the state had spiraled upward from ten per 100 doctors in 1979 to 25 per 100 by 1985—an increase of 150 percent in just six years. From 1970 to 1984, the large Detroit metro-area counties of Wayne, Oakland and Macomb had seen their malpractice filings jump 1,100 percent. Medical professional liability insurance premiums had also doubled between 1980 and 1984; growing even faster in the higher-risk specialties.
Amidst the spiraling increase in medical malpractice lawsuits and skyrocketing costs of medical malpractice insurance, Michigan doctors began to curtail the number of high-risk procedures they would offer. In 1985, 42 percent of Michigan family physicians reported they had either ceased delivering babies or reduced the number they delivered; an even higher percentage of doctors reported that they had cut back on surgery and treating patients likely to require intensive care.
In response to cries from the healthcare community, the Michigan legislature passed Public Act 178, a bipartisan piece of legislation that introduced several major changes to the state’s tort law. The 1986 reforms included:
- Venue Reform. To curb the practice of trial lawyers venue shopping for plaintiff-friendly juries, Public Act 178 required lawsuits to be filed in the county where the alleged injury occurred.
- Joint-and-Several Liability Reform. It was deemed that often trial lawyers would look for the deepest pockets to sue, regardless as to whether the deep-pocketed plaintiff had very little to do with the alleged injury. Prior to reforming joint-and-several liability, defendants that juries determined to be as little as 5 percent at fault were being stuck paying as much as 100 percent of the damages. Public Act 178 limited a defendant’s damage payout to his or her share of responsibility.
- Expert Testimony Reform. For medical malpractice cases, the 1986 law imposed a higher standard for expert testimony.
- Non-Economic Damage Caps. Public Act 178 established a $225,000 cap on non-economic damages, such as pain and suffering, although it provided for various exceptions.
The tort reforms enacted by Public Act 178 effectively stabilized medical professional liability insurance rates in Michigan, and the number of doctors performing high-risk procedures, such as obstetrics, slowly began to increase. By 1993, the Michigan legislature returned to its medical malpractice tort reforms in order to strengthen them in the face of a once-again nationwide crisis in medical professional liability insurance costs. In response, the legislature passed Public Act 78 of 1993, another bipartisan round of reform to Michigan’s medical malpractice legal system. The updated reforms included:
- A Tightening of the Non-Economic Damage Cap. Public Act 78 upped the non-economic damage cap to $280,000, but closed many of the exceptions for piercing the cap that were left in the 1986 reforms.
- Increase the Standard for Expert Testimony. The 1993 reform created an even greater standard for expert testimony, after it was deemed that many of the experts testifying for the plaintiffs were becoming a cottage industry unto themselves.
- Affidavit of Merit. Public Act 78 required all medical malpractice plaintiffs to file an affidavit of merit.
- Arbitration. Public Act 78 permitted binding arbitration in medical malpractice cases that involve damages not in excess of $75,000.
As is common knowledge in tort reform circles, every reform will ultimately be challenged in the court system by the state’s trial lawyer lobby. Michigan’s reforms were no exception, but the trial lawyer contingent has come up short in each of its challenges. Defending itself against the allegation that the reforms violated a citizen’s right to trial by jury, the medical liability reforms enacted by the state legislature were ultimately upheld as constitutional—first by the state court of appeals in 1996; the state supreme court in 1999 and again in 2004.
The effect of Michigan’s 1986 and 1993 tort reforms can be seen in its stable medical professional liability insurance premiums and an increase in the supply of physicians and specialists practicing in the state.
