Medical Malpractice Insurance in Maryland

Medical malpractice insurance premiums in Maryland are among the more expensive in the nation. Rates in the region are so expensive that—at the peak of the last hard market in 2004—surgical groups shuttered their practices to protest the sky-high premiums they were suffering.

This most recent fight for tort reform started when Medical Mutual Liability Society of Maryland—the largest medical malpractice insurance company in Maryland—was granted a substantial rate increase on Jan. 1, 2004. Premiums for some specialties jumped by as much as 91 percent, and Maryland’s healthcare professionals cried that—without effective tort reform—they would be forced to relocate or retire and that the citizenry’s access to healthcare would be greatly threatened.

With a Republican governor having been elected in 2003, tort reform legislation being signed into law seemed possible, but with a Democratically controlled General Assembly and a reputation for having more trial lawyers per capita in Baltimore and the greater Washington, D.C., area, than anywhere else in the country, the possibility was still a long shot.

On Jan 21, 2004, the Maryland Medical Society (known locally as MedChi) organized a rally on the steps of the statehouse to protest the recent medical malpractice insurance premium increase. Hospitals, physician groups, MedChi and medical malpractice insurance providers banded together to form the Alliance to Preserve Access to Healthcare, and more than 2,000 physicians from around the state were present.

The protest was enough to get the attention of lawmakers, and the 90-day legislative session included several hearings on tort reform. Unfortunately, lawmakers failed to recognize the urgency of the matter, and the Maryland General Assembly accomplished little in regard to tort reform, opting instead to appoint special panels to study the problem.

While the tort reform debate was given little more than lip service in the Assembly, the four remaining medical malpractice insurance companies in the state were paying out record jury verdicts and settlements. The insurers pointed to these liabilities when it submitted to the Department of Insurance plans to again increase premium rates in 2005. The imminent rate increase, coupled with the previous year’s premium jump, left many in the healthcare community at a loss as to how they would be able to continue practicing.

A group of surgeons called for an emergency meeting of the Maryland Chapter of the American College of Surgeons in September. Two surgical groups located in the Western portion of Maryland agreed to close their practices until some sort of tort relief was provided. These two multi-specialty surgical groups provided 65 to 100 percent of the surgical care to patients in Western Maryland. This was the move that ultimately captured the media’s outlets. With 67,000 births and almost 500,000 annual surgeries, Maryland faced serious access to care issues if other practices followed suit and closed their doors.

With a media spotlight on medical malpractice insurance reform, Gov. Robert Ehrlich called a special session of the Assembly for the week between Christmas and New Year’s Day. From that special session, the Maryland Patients’ Access to Quality Healthcare Act of 2004 was passed to the disappointment of many in the healthcare community. Essentially, during debate, most of the more effective tort reform measures being considered were either diluted or eliminated. The result was tort reform without teeth, but most involved had to agree that small reforms were better than no reforms. The positive reforms contained in the Maryland Patients’ Access to Quality Healthcare Act were a tightening of the requirements for expert witnesses, the requirement of a certificate of merit and the creation of a $40 million rate stabilization fund.

To date, none of these reforms have had any significant impact on Maryland’s high medical malpractice insurance rates. “Maryland’s Largest Malpractice Insurer Requests 2012 Rate Increase”
In a July 2011 filing, Medical Mutual Liability Insurance Society of Maryland—the state’s largest liability insurer of physicians and healthcare workers—requested a 4-percent premium hike for 2012 from the Maryland Insurance Administration. In a letter to its insureds, the company explained that while claim frequency remained stable, the cost of defending its doctors has grown due to market trends and “appellate challenges to our current tort environment.”

This request marks the first time since 2005 that Medical Mutual Liability Insurance Society of Maryland has asked for a rate increase. In fact, the insurer has given significant dividends to its insureds during the last three years.
